Open Question: Please help with this legal issue!?
So I have this friend. Her father had an affair with his secretary of 2 years after being married almost 40 years to his wife. Since then, he has been telling them both that he wants to be with them. This has been going on for a year and a half. His wife has been a housewife for their entire marriage and has no employable skills as well as back problems as she is in her upper 50's. Now, the husband has been spending the days at his wife's house and then spending the nights at his mistress's house with her two daughters for the past year. All this time the wife has been believing that he is sincere when he says he wants to come back to her. Regardless, he stopped paying the mortgage on their house and all of their other bills so that he could pay for his mistresses rent and their bills. And to support his alcoholism. Now the husband is going to be getting a large settlement from where he used to work - 6 figures. But it will be given directly to him. I'm confident that he will take off with it and let his wife lose their house instead of paying the mortgage. The wife has absolutely no money so she cannot get a lawyer to file for divorce or to work out how to be able to have access to the settlement so that she doesn't lose the house. She tried legal aid but since she is still married to her husband and they own land, she is said to not be eligible for legal aid help. Even though all of that property is currently on the market and has been for 3 months. Regardless of what you think of her for staying with her husband, she is now in a desperate situation. She doesn't know where to turn. Does anybody know ANYTHING that she can do? This will destroy her. (more...)

Open Question: Welfare question.Please look?
If you or a family you know is in the Welfare program (to pay rent) please help. I have been looking for an apartment that takes welfare for 2 months and I have not found any. We are 2 adults and a 1 year old. So the question is: what will be the maximum income for a 3 family member (if there is any). I feel hopeless about finding an apt. but I have no money for the down-payment. So please if you have a 3 member family please tell me more or less how much is your monthly income so that I will have an idea.I called the office and they told me I have to go to the office to find out if I qualify but I don't really feel like waisting my time with those nasty workers. I hate the idea of applying for public assistance but I will do whatever it takes to give my son a decent life. Thank you all and keep in mind not to make me waist time with stupid comments!! Open Question: Should I allow a tenant to be removed from the lease?
I asked this question earlier, and got 2 great answers, but I'm looking for a few more opinions, from landlords or even tenants who have been there. Rent out a 3 BR TH to 4 women, and one woman has a child. The woman and the child have the basement, the other 3 the bedrooms. House is very cluttered, very messy. Not too thrilled with it, I know at the end of the lease (May 2010), I will have to do a lot of work on it. One tenant came to me asking to be removed from the lease. She would like to move out. She has the agreement of those on the lease. All tenants are employed. One is military. I'm not too worried about rent. It seems she just does not get along with the other ladies, and living with a child is more than she bargained for, with noise and rent. I'm hesitant because she seems to be the only one who cares about the house. But she did take initiative to get the other tenants to agree to her departure. What should I do? (more...)

Sales To find out my sales figures I decided to find out what is the average spending of each customer, than I multiply this figure by the average number of customer which I expect to have each day. The average spending of each customer would be £3.5 (piece of cake a cup of coffee) and I am expecting to get about 8 customers per hour. To make my calculations more accurate I decided to visit on of the competitive business which is located in different part of town centre. The main reason of it was find out how many customers they could get within one hour. This research confirmed my predictions, however I am excepting to sales will increase during summer months and Christmas time ? Rent My premises is located in market place. By locating my business in such a populated place there is going to be much better opportunity to get more customers because there is a wide range of shops which attract many people. Rent costs me £16,992 per annum. ? Wages and employing staff I want to operate my business by myself, however, I will need to employ two members of staff. I will need one full time worker to help me operate the business in general and a second employee to work during the lunch time hours to help with preparing snacks and lunch dishes. I will offer them temporary, 12 month contracts, the first contract on a 40 hour per week plus overtime basis and a second contract on a 20 hour per week plus overtime basis. ? Gas and electricity My figures show an average expense for a small catering businesses. ? Telephone and Internet I need access to Internet and phone to contact with my supplies and make orders. I decided to get telephone and internet form Talk Talk. It costs me just 16.99 and this price includes unlimited phone calls to UK landlines in the evenings & weekends, 36 international destinations, TalkTalk customers anytime and free broadband. ? Advertising The advertising of the business in first two months (January and February), would cost £110. This included printed leaflets and advert in local newspaper. In next months it would decrease to £6 and this amount include advert in local newspaper. ? Office expenses My office expenses includes small expenses like toner carriages, printer paper, postage etc. ? Lease of equipment Lease of assets It allows my business to use an asset without having to buy it. I do not have to put up large sums of capital to be able to use asses and I can exchange the asserts for a more modern. It is good option for me because my capital is limited." Open Question: Housing Benefit/Local Housing allowance?
I know i'm entitled to it up until June when i finish my course at college. I've been having trouble find somewhere because since i'm under 25 I only recieved a shared housing rate. Does this mean I can only stay in shared accomodation or can i find somewhere on my own and pay more, or in turn will working more affect my housing benefit? Also, if i find a shared flat do they have to accept that i'm paying part of the rent through benefits or can they refuse me? Open Question: What legal recourse do you have if someone owes you money on a car?
Here is the situation: a friend of mine allowed her struggling niece to move in rent free. During this arrangement, my friend purchased a used car for her niece to help her get out and find a job. She tagged the car and put new tires on it as well. To appease her husband, my friend did take the measure of writing up a contract/agreement (hand written) that her niece would pay back the $1100 spend on the car, and the niece signed it. Now however, the niece has left and of course taken the car. My friend spent a lot of money on clothing, food, entertainment and general welfare to take care of her grown niece and help her to feel better and get on her feet. My fiend is left feeling taken advantage of however! What kind of legal recourse does she have, and is it realistic to think she has a chance of getting that $1100? The car title is in the name of the niece. My friend is in possession of the title though and noticed that there is a place for "lien holder" information. Can she fill this out, since she does have a signed agreement? What step would she take after that? (more...)

Open Question: Can I float a check if the funds are already clearing?
I deposited $3500 on the morning of the 5th. It's now the afternoon on the 7th and they haven't cleared. These checks are good-- paycheck, payment from my mother's estate, a check from my roommate that I know will clear (He showed me his statement). I'm two days late on the rent, and I really want to pay it today. Since the funds are already clearing, can I write a check for $1400 without freaking out? (more...)

Open Question: Address changed ? can i still apply for passport. ? What proof is requred?
My home town is Raipur Chhattisgarh. i am living in Karnal Haryana for past 2 1/2 years. first 2 years i did my Post graduation during which i lived in Hostel and then for past 6 months i have been living on rent in Karnal. I want to apply for passport. i went to passport office Karnal where they said that i cant be done. i could not get a satisfactory answer from them and they simply rejected my application. i have completed all the documentry formalities.i got additional PP forms and proof of my 2 years stay at my Hostel and also my current residential proof (on letterhead from the institute i am working in ). I dont have any legal agreement with my landlord so unable to produce phone bill etc. for my current address. Will the address proof as Letter from a gazeted government officer will not serve. Can i apply legally from Karnal or i have to apply from my Hometown. Please suggest (more...)
