How to File for Chapter 7 Bankruptcy
In these times of massive credit card debt and stagnating incomes, filing for bankruptcy has become the only relief for thousands of people. The information in How to File for Bankruptcy is so complete that a person can file virtually on his own, without needing to hire a lawyer. By no means does the book encourage filing for bankruptcy, but it will help anyone in serious financial trouble determine if bankruptcy might be a sensible course to take, and examines what kind is appropriate for different individuals. All of the necessary forms are included, complete with explicit directions. Like all Nolo Press titles, this is a straightforward, no-nonsense book of useful advice and specific guidance, written in clear, easy-to-understand language.

When You Have to File for Bankruptcy: Step-by-step Instructions to Take Control of Your Financial Future
According to the United States Bankruptcy Courts, the number of bankruptcies filed each year is on the rise. People file bankruptcy for a variety of reasons, such as preventing foreclosure on their homes, preventing repossession of property, loss of employment, or reducing or eliminating debts. The most common types of bankruptcy for which individuals file are Chapter 7 and Chapter 13. Chapter 7 involves the surrender of property to pay debts, while a Chapter 13 bankruptcy allows for the retention of property but requires payments over the next three to five years. This book is divided into three sections: evaluating your need to file for bankruptcy, how to file for bankruptcy, and what to do after you have filed. In the first section, you will be provided with evaluation tools, determine your eligibility, learn how to check your credit report for accuracy, and learn about the different types of bankruptcy for which you can file. In the second section, you will learn about the major changes in bankruptcy law, bankruptcy lawyers, alternatives to filing for bankruptcy, bankruptcy code, collection agencies, exempt property, nondischargeable debts, what bankruptcy can and cannot accomplish, the automatic stay provision, foreclosure, tax levies, bankruptcy fees, the 341 meeting, bankruptcy myths, the initial consultation with your lawyer, and bankruptcy timelines. You will learn the answers to some of the most common questions about bankruptcy, such as: Will creditors stop harassing me? Will my spouse be affected? Who will know about my filing? Will I ever get credit again? What does it cost? The final section will provide a brief overview of what to do after you have gone through the bankruptcy process. We will address the issues of how to get car loans and home loans and how to build credit after bankruptcy. Whether you are filing for bankruptcy for the first time or, unfortunately, you have been through it before, When You Have to File for Bankruptcy will provide insight into the complex and burdensome process.

Open Question: My student loan is in a default, can I find another lender to refinance so that I can get out of default.?
My chapter seven bankruptcy was recently discharge, prior to filing for bankruptcy, my federal student loans went into default. I was given the opportunity to get out of default via a Rehabilitation program; I made my payments on time over a period of nine months and even while I was in bankruptcy. Now that I am out of bankruptcy, I have the chance to get of out this Rehabilitation program, but the company handling my default collection, AES, is taking forever to release me out of "Rehab", I still have a negative credit rating on my credit report because of the default and they told me that I will still be required to pay until a lender is willing to refinance my students loans. I did everything I was suppose to do to get out of default and I still am even almost after a year, I am wasting more and more money. What options do I have to take control of this.

Open Question: Clean credit requirement at your employer?
I have worked at the same company for about 4 years...I have an EXCELLENT record while there (3 promotions, etc). My company has a requirement that ones credit report must be clean. In October I was forced to file for bankruptcy (due to divorce), I know that my employer pulled my credit about 9 days ago, but no one has made mention of the bankruptcy. At this point, should I still be concerned? Has anyone went through a similar situation, or can offer any advice?

Open Question: Questions about Chapter 7 Bankruptcy to those experienced?
Long story...I ended up getting divorced last year and my wife left me with a ton of debt and two car payments while I was medically unable to work. My lawyer decided it was probably in my best interest to file for chapter 7 so I did in August of 2008. I had my hearing rescheduled being unable to make it because of medical problems. I ended up getting a great job at the end of the year and made more than enough money to pay my debts. Problem is my lawyer said if I try to "unfile" it will still reflect on my credit and I might as well keep going with it.
My problem now is because of the bankruptcy I had to return my vehicle and I am basically in limbo without any sort of transportation. My ex-wife got off clean and free and got to keep the vehicle I paid off and I have been footing it and getting by so far. I have my chapter 7 hearing this week, I would like to finance a car for about $15K or less with money down. I spoke to a few dealerships and they said they can't do any thing until after my court hearing so the companies won't get dragged into the Chapter 7. Other people are telling me I need to wait 60 days for actual paperwork before I can finance a vehicle. Which is right is there any thing I can do to get financing soon other than a "buy here pay here". I understand interest rates are going to be high as a penalty of the BK.

Open Question: My atty had me agree to a temp order giving me possession of the home, make payment to him on a motorcycle ....?
he had sex with my sister, and had me give him possession of a motorcycle. He told me,my wife and her attorney that he would pay off the debt on the motorcycle, and that i would then make payments to him on the motorcycle. He never paisd off the bike, and after having it for 4 mths ,he told me he would rather have $6000.00.I have no way of coming up with $6000.00.I am behind on my mtg, child support and motorcycle payment. If i file bankruptcy and fire my atty, would i likely be able to get out of having to be solely responsible for the mtg and bike and her atty fee's for suing me ?I have a contempt hearing in two weeks for getting behind due to losing my income. My atty wants me to offer to get 20 days of visitation a year with my son.I am wondering would i get more than that if i went in pro se?I feel my atty lied to me from day one ,intentiaonally getting me to a point where i would not get to see my son.He told me he would get the courts to pay for a guardian ad litem, but had it written for me to pay. What can I do?i havent seen my son in 5 mths.He is 18 mths old now and 1 thousand miles away
