Open Question: Separated for 2 months, husband wants to claim head of household and child credit?
We lived in Idaho and my husband left me and my son for another woman. At that time I had no where to go because I couldn't afford our rent by myself and my husband took our only car.I had a job but I wasn't making enough to survive on my own.I took it really hard when he left me so my sister flew me and my son down to California since my whole family lives in Cali. I've been here for 2 months and I'm planning on moving back to Idaho to get a house with my very close friend who just filed for divorce also. I've asked my husband to start the divorce process since he can afford it and I can't, but he still hasn't filed. Anyways, our son is living with me and my husband hasn't sent us any money to help with his diapers/food/medicine or anything even though I've asked (I'm in the process of trying to get child support) Today he emailed me and said he is claiming head of household and child credit because he needs the money more than I do to pay for his bills...also, his job doesn't take anything out from his paychecks for taxes He will most likely get his w2's before I can get mine My question is, Is he allowed to claim child credit when our son is living with me? also, is there any way I can file my taxes without my w2s? and, is there any way I can prevent him from claiming our son? and last, is he allowed to go to H&R Block and claim my son without my sons social security card? Voting Question: Establishing dual residency - Nevada/Idaho?
I own a home in Idaho. Because the job market is what it is, I have accepted a temporary postion, basing me in Nevada. I return to my home in Idaho once a month, sometimes more (have had 2 interviews for permanent postions so I can come home). How do I prove this to the state of Idaho, that while my job and majority of residence is in Nevada, I am, and always will be an Idahoan? (more...)

Resolved Question: Haven't lived either place long enough (or too long to file?) Nevada, Idaho, California?
My husband and I have lived in Idaho for 5 years. He moved to California (supposedly to work) in June. I got a job in Northern California in October, but I chose to live in Nevada as the housing options were far better. I am ready to file for divorce but I am STUCK. -Idaho says you have to live there the last 6 weeks. (I still a home there, not sure if I claim dual residency with that one) -Nevada won't touch a divorce that involves minor children for 6 months -California will do it since he has lived there for 6 months, but the minute it is filed an order goes in effect saying neither parent can remove the child from the state. He is an alcoholic and his behavior has become erratic and threatening, he has gone as far as writing a suicide note that he did not follow through on, nor do we believe he planned on doing so. He is now using his repossession agent contacts and resources to track me down wherever we go. He implies threats, but never actually makes them. I am concerned for the safety of myself and my daughter, but cannot get a protective order without the divorce at least filed as we are married and he has not made any direct threats, Any suggestions? This is the verbiage from the Nevada divorce complaint packet: "A child, or the children, MUST be a resident, or residents, of the State of Nevada for a period in excess of six (6) MONTHS before the State of Nevada can enter any orders regarding custody, or visitation, of the child or children. This is STATE and FEDERAL LAW. If the child, or children, are not residents of the State of Nevada for a period of more than six (6) months immediately prior to the filing of the Petition or Complaint, the State of Nevada has no jurisdiction over orders regarding the children." Voting Question: Can a minor emancipated through marriage move out of the U.S. without their spouse? What are the ramifications?
I am an minor who is emancipated in the state of Idaho through marriage I have been married to my spouse for several months now and for private reasons I need to move to Germany for a while. 1. Is this legal? 2. Will Germany recognize my emancipation through marriage? Does Germany even recognize United States emancipations? 3. What problems might I run into with the German Government or with the U.S. Government if I need dual citizenship? Or might I be able to receive a S.O.F.A. card if I get a job on the nearby U.S. military base? 4. What ramifications can you think of? I would really appreciate your help with this matter. Thank you, Justin I am under 18 .. I am 17 but considered age of majority (18). I am an american citizen and I am needing to go to Germany to live with a family member who is sick and dying. She lives in Denkendorf which is right next to Stuttgart where there is a military base which is where I was planning on getting a civilian job. I am not sure how the whole living there thing would go .. Whether I would need to get dual citizenship, or a visa, or a S.O.F.A stamp ... I am kinda in the dark about this whole thing myself .. even where to start or who to talk to. All I know is one of the most influential people in my life is dying and I would like to be there to help take care of them ... Help?! (more...)
