Open Question: What can people do when Homeowners' Association rules violate their constitutional 4th amendment rights?
Home Owners' Association in question (and I understand it is becoming widespread) has just revised the rules to grant themselves access to your privately owned condo unit to check that you are following the rules. They have demanded everyone's keys and have indemnified themselves, adding that it cannot be considered "trespass". I believe it IS trespass to enter another's privately owned home without permission, and it is a violation of our 4th amendment right to privacy and protection from illegal search. I have checked, and because an HOA is not an arm of government, this situation is not in the normal purview of the ACLU, our usual Constitutional watchdog. This is becoming a serious threat to our nation's freedom and the sanctity of our homes. The police cannot search your home without due cause and a search warrant, but your HOA can. What redress and protection do homeowners have in a neighborhood governed by a homeowners' association that has granted themselves power and responsibility far beyond their original purpose - the maintenance of the common areas? The "Blu-ray Disc Founder group" was started in May 2002 by nine leading electronic companies: Sony, Matsushita, Pioneer, Philips, Thomson, LG Electronics, Hitachi, Sharp, and Samsung. Spearheaded by Sony Corporation, on February 19, 2002 the companies announced[2] that they were the "Founders" of the Blu-ray Disc and later changed their name to the "Blu-ray Disc Association" on May 18, 2004 to allow more companies to join their development. Some examples of companies that signed in include Apple, TDK, Dell, Hewlett Packard, The Walt Disney Company, Warner Bros. and Universal Music Group. Here's what is being proposed to raise money to maintain roads: --- Projected shortfalls in revenue led the National Surface Transportation Policy and Revenue Study Commission, in a report issued in January 2008, to call for an increase of as much as 40 cents a gallon in the gas tax, phased in over five years. Charles Whittington, chairman of the American Trucking Associations, which supports a fuel tax increase as long as the money goes to highway projects, said Congress may decide to disguise a fuel tax hike as a surcharge to combat climate change. Transportation is responsible for about a third of all U.S. carbon emissions created by burning fossil fuels. Traffic congestion wastes an estimated 2.9 billion gallons of fuel a year. Less congestion would reduce greenhouse gases and dependence on foreign oil. "Instead of calling it a gas tax, call it a carbon tax," Whittington said. Motorists' habits spur call for tax increases http://news.yahoo.com/s/ap/20090102/ap_on_go_ot/gas_tax --- OK, raising gas prices might encourage people to drive slightly less, but not a single dollar of the revenue raised would go directly to reducing global warming. Furthermore, higher fuel prices encourage people to switch to more fuel efficient vehicles, LOWERING revenue from gas taxes. Why not first eliminate the approximately $80 billion in subsidies to the oil and gas industry? Why not better allocate the over 50% of our federal income tax dollars that go towards the Department of Defense (and interest paid on war debt)? Donald Rumsfeld admitted in 2001 that the Department of Defense was so poorly managed that it couldn't even account for $3.4 trillion dollars. (Coincidentaly, that story broke on September 10, and it was military attacks using airliners the following day that effectively buryied the Department of Defense scandal, the predictable patriotic flag-waving by politicians even resulting in tremendous funding increases to the DoD, increasing the national debt to astronomical levels and setting us up for future financial collapse.) So do you think politicians will take the bait and propose another "global warming tax" that really has its funds diverted to other programs, like Los Angeles did to fund public transit? If politicians do, will you vote them out in 2012? As a side note, I am concerned about global warming, but that's all the more reason to oppose measures that give the public the mistaken impression that they've already funded a response, and which divert funds that otherwise could have gone towards directly productive responses making our power and transportation infrastructure more efficient. Resolved Question: What if, a homeowners association rule caused hardship for someone who is handicapped?
My association has passed a rule that cars will need to be parked in our own garages overnight. We can no longer park in our own personal driveway overnight as of Jan. 1st. This causes hardship for my quadrapligic relative that lives with me. He must have a garage stall open for him to smoke cigarettes in when the temperature is extremely cold out. Also, he needs to store his power wheelchair and other handicapped supplies in a garage bay. The association board appears to be having a hard time cooperating with us. They will accept a doctors note for parking in the driveway (he is obviously handicapped and shouldn't need anything). Although a doctors note is acceptable, they frowned upon this. We will probably get a violation for storing handicapped equipment in a garage stall because it is blocking a parking space in the garage. When I purchased this unit my intentions were to park in the driveway from day 1. Now the rules are being changed from under my feet. What are my rights here? What can they do if I park in the driveway anyway? Although I can acquire the doctors note to park in the driveway, they will not allow me to use the garage for storage of handicapped equipment. My point is, there is zero communication with any head/board members of the association. I cannot get it through their minds. I have had a meeting with them personally to work on this issue.
