Resolved Question: I made an offer on a bank owned property. ?
A week later they asked my realtor to have me fill out addendums (as-is, escrow and title). Everything i read says they usually asked for these after an offer is accepted. Do you think they are considering accepting my offer? Or do some bank just ask for these with the original offer? I did not get notification that my offer was accepted nor did i get a counter offer. My realtor said she received it faxed to her on Saturday morning that they needed the addendums. addendums didn't have any more information. (more...)

Resolved Question: Loan Officer Fraud.. What do I need to do?
At the end of July I applied for a home loan. The loan officer said I was pre-approved at 145k (have the papers) and I began looking for a house. I was told that I needed to put the 5% buy-down for a locked interest rate and loan type. I found a house for 139k and put in an offer that was accepted. During the whole time the house was in escrow, the loan officer kept having problems getting the loan docs to the title company. After almost 3 months of going back and forth, the sellers decided to cancel my offer. The loan officer told me that I would be receiving a check in the mail from Countrywide (who was supposedly the lending company that received my loan buy-down deposit). I did not receive the check. I ended up finding out that she does not work for that Mortgage company anymore, as well. Questions... How could I go about getting my money back? I do have the receipts on the company letterhead with the amount that I gave as well as it stating that if the loan did not go through or I did not find a house, the entire amount would be refunded. Is the mortgage company liable at all in any way, since that is where she was employed at the time and that is where I started the whole loan process? Should I go after the mortgage company and/or her if I decide to take them to small claims court? Any advice on what I could / should do? Thank you very much, (more...)

Resolved Question: House escrow closing?
We are buying a bank owned home. Everything went through, the loan and everything, we signed the docs on the 24th of Nov and the Title company has been waiting for the seller (bank) to respond for the past 2 weeks. they aren't communicating with us very well or doing anything on their part to close this. We are stressed and thinking of sending them a notice to perform which we know can backfire too. What would you do in our shoes at this point? We need to give notice about our current place and can't move on to do anything because of this. (more...)

So we are buying our first home which is a bank owned foreclosure and I need help...I would like to know how I could eliminate some of the stresses? I know its a tough market now, but we've been in the escrow for 2 months. We signed our final pile of docs two weeks ago and seller who is the bank has yet to sign off on their end. The title company can't move on without their signatures and we can't move on with anything. We can't get planning on moving out of this place, planning on remodeling, etc. Its been so stressful and finally when I got relieved when the docs were signed and I was patient for a week but don't understand why its taking 2 weeks to sign the docs. The seller's agent says she did everything on her part and pretty much said to our agent 'don't call me everyday. I did everything I could'. We are kept in the dark. We are at the point where we are ready to back out. I've been loosing sleep over this 'not knowing'. We are considering signing a notice to perform form but our agent told us that this could sometimes push them to get things done but other times it can backfire too. Please help! (more...)

Resolved Question: Re-finance Good Faith Questions?
My husband's secretary sent some loan docs home with him this evening.She is trying to get a re-fi on her home and is concerned that she is getting ripped -off.I looked at her docs,and I am surprised at some of the fees as well.Can someone advise me on whether these are typical fees or extreme. Total Loan Amount 124,135.00 Loan Origination Fee 1% 1,220.00 Mortgage Brokers Fee 3% 3,724.04 (that is the one that seems really high ,to me.) Processing Fee 895.00 Underwriting Fee 695.00 Title Insurance 755.00 Closing/Escrow Fee 600.00 The loan is in Florida if this helps.Maybe the fees are the norm these days,but it seems "packed" to me. Resolved Question: When a house enters escrow on an FHA 1st time Pre-qualified Home Buyers loan, can the seller cancel if...?
The FHA Appraiser requires a gas water heater to be re-installed 3 feet off the ground? We bid We won Send in deposit, down, & fees to title co. Paid for home inspection Received a closing date from Bank Have 5.6% rate locked in for 45 days Now the agents are playing cat & mouse Can we end up losing this house if the seller (bank owned) doesn't want to spend the money on these repair REQUIREMENTS? They knew we were first time FHA home buyers when we bid & submitted the bank loan approval letter... THEY ACCEPTED. Can they opt out & re-list house? The suspense is killing us. Who should we start calling? This agents don't seem to be doing their jobs & the mortgage agent seems far too busy to get the paperwork faxed out. Is there something we should know about buying a bank owned house that the agents aren't telling us? This is in California. Also paid appraisal fee directly to big name bank prior to paying for home inspection & the water heater issues were of a different nature on the report. WE don't want anything repaired. The property was purchased in "as -is: condition. It's the FHA people who won't release the $$$ until this repair is completed. They won't allow us (the buyers) to do the repairs... the agents seem clueless... as are we. FREE to WALK someone has answered??? Nothing is FREE $2000 Transaction fee $490 FHA appraisal fee $400 Home inspection fee $2,890.00 non-refundable AGENTS waiting for one another to FAX contracts & blah blah blah. We also paid additional $2500 deposit. We can get that back! The agents are driving us insane. NO paperwork...it's all on the internet! Only the bank has paperwork & they are holding it until reapirs are done by seller (another bank). Ahhhhhhhhhhhhh! Hell yeah...we're CONFUSED! Resolved Question: What's a quick way to transfer my parents home to my name?
My parent's home is paid off. They are recently divorced. It's actually empty as we speak. I was going to go through escrow to buy the house, but my parents suggested ruling out the middle man since they won't be getting much for the house and are ready to get rid of it. My mother's only concern is that her name is off the title of the house so that she can get health insurance. My parents both want me to have the house instead of going the hassle of finding a buyer. How do we go about transferring the house to mine and my husband's name? Is there a quick process or a quick form? (more...)

Resolved Question: When should buyers agree to pay per diem on bank repo?
We recently purchased a bank repo home with a 30 day escrow. If the escrow exceeds the 30 days, there is a 100 dollar per day per diem charge (including weekends) up to the closing date. The lender promised to get it closed within the time, but when they obtained the legal documents on the house it is titled as a duplex, when it actually just has a little 300 sq. ft. guest house. The underwriter demanded the appraisal be done again as a duplex instead of how he wrote it as a single family residence. The agent had asked for a one week extension from the bank which they approved, but now the appraiser is having problems finding comps in the area for duplex comparisons, so it is going to extend beyond the already waived date. Our agent (also the sellers agent) says she can't submit another waiver request and we will have to pay the per diem. Is this fair and correct? I thought the per diem was to ensure WE submitted all our documents timely, NOT that the title on the house has issues and the appraisal has to be corrected. Can a per diem waiver be submitted a second time, or is she correct? Thank you in advance for any information on this subject.... (more...)

Resolved Question: why my house title is still the builder's name?
1. we bought our house from the builder in Aug 2008 2. we have an escrow account with our mortgage company two weeks ago, we found out that our house title is still under builder's name in our county, and we don't have a copy of the house title deed. how can we get the copy of house title deed? who shall we contact, the mortgage company, or the title company? thanks!
