Open Question: What can I do to help our newest member of our family be happy?
We just adopted a boxer about two weeks ago. Her previous family was evicted from their home and they left her there by herself. She is a great dog, she listens when we call her name, she won't eat until we say it's okay, she sits, she is house trained.... She is great. Except she seems so sad. I feel so bad for her I'm not sure what to do to cheer her up. Any suggestions would be great. Thanks (more...)

Open Question: Help me write an agreement of non-payment of shared electric.?
I live in a upstairs/downstairs house. My husband and I live in the downstairs unit and a family of 6 lives upstairs. The electric is under our name and its supposed to be paid split amongst the 2 households. The problem is that they are behind by 4 months totaling to $859. The next electric bill is coming in a few days and probably is going to jack their balance to $1000. The first week we moved in, we didn't have electric because they haven't been paying their bill on time. I'm soo fraustrated by it b/c every month the bill goes up. They stole our cable service so I called the cable company to disconnect them. A week later they got satellite dish cable service where this big satellite is on the roof which looks soo ugly. They have a cable box in every room because I seen the cable boxes. Also, they just recently installed a a/c unit in one of the rooms. More to that is, they have friends and their 19 yr. old daughter b/f stay there. I use the washer and dryer once a week while the rest of the week, they're using it. I'm expecting my first child in 3 months and we are behind on our bills b/c we have to pay the electric. It's soo fraustrating for us. We actually want them evicted because this is going to be a ongoing trend for us. They don't care, they're totally taking us for a ride. Please help me write out some kind of agreement of electric that if they don't pay their electric on time, they could get subject to eviction. I want to present some kind of paperwork to our landlord so that they can see how much the upstairs family have been a burden to us. (more...)

Open Question: Possession of my rented property?
I have long term tenants who have lived in my rented property since 2005 there fixed term tenancy ended back in june and there now on a periodic tenancy. In September i issued them with a section 21 notice stating on the 11th November i wish to seek possession, My tenants are DSS and family members, the council won't help until i take possession through the courts. I said to my tenant I would not start proceedings until after christmas (now) however am I too late to evict them with the notice to leave which expired on the 11th november? Should I of acted within 28 days? Do I need to do another notice? Open Question: Does anyone else think that these bastards should be done for murder?
http://uk.news.yahoo.com/4/20090107/tuk-dog-killers-slash-disabled-woman-dba1618.html It really grates on me that they will get a light sentance, probably not even custodial (over the dog, not the woman) for stabbing to death a defenceless animal, whereas if it was a person they would get a life sentance. I just do not see how in these circumstances these little bastards can get away with it. That poor little dog must have been so scared and in so much pain, i actually have tear in my eye thinking about it. And the poor owner will probably have been left devestated. A pet is a member of a persons family and if anyone did anything like that to my darling little cat (god forbid) and got off lightly I would feel sick that justice hadn't been done and would probably break the law to get my own justice. I know a woman round where i live got a lifetime ban on keeping animals and still kept them, in squalid conditions, they were suffering and a few died and all that happened to her was that she got evicted from her council tenancy (although actually left before the bailiff came) and was given an asbo. She should have been locked up for what she did. If she had kept a child or a disable/elderly person in those conditions she would have been, but she got left off because they were animals!! Resolved Question: I need to find out what would be the best way to evict a tenant.?
My grandfather lives in a 2 family home in the state of NJ. He rents rooms on the 2nd floor of the house and is having problems with a tenant who is dirty and not taking care of the surroundings. He has paid one month of security with 1 month rent. This was for the whole month of Dec, it is now Jan and no rent. My grandfather just wants him gone. From what I know, room renting is somewhat illegal in this state but yet everyone does it. What can be done here? Should I have him give the tenant an eviction letter? Should I go to court? Open Question: How do I prevent/handle retalitation from apartment management company?
My sister in law is also my babysitter. She slipped and fell while holding my two year old boy today. Thankfully she caught the baby and he was fine, but she hit her back on the steps and threw it out. The steps and walkway were covered in packed snow and ice (and have been that way for some time). She contacted our building manager asking for compensation for the trip to the doctor. The manager flatly refused, as did our management company, and claimed the steps and walkway were safe. The good news is my sister in law had the presence of mind to snap a couple of pictures. Her husband also drove by to snap a couple more, and caught a picture of the manager with an icepick and a shovel covering it up. Getting to the point, my sister in law has contacted a personal injury attorney with intent to sue. What do I need to do now to prevent my management company, and my building manager in particular from inventing reasons to have my family evicted from our home. If this is attempted what options do I have in the state of minnesota to defend my family against this and to prove it is retaliation. We are not in a position to move, and even if we are the school district is good (our daughter is in school) and the neighborhood is safe. Unfortunately, though, my sister in law and her husband are in no position to eat medical expenses. He's just been layed off and they're struggling as it is, so I really can't tell them not to do this. I need to know how to allow them to seek proper compensation, while not losing the apartment that my family calls home...and no, I am not able to cover her medical expenses so that she doesn't have to seek compensation through litigation. Resolved Question: How would you address this situation with landlord?
We have been living on the top floor of a 2 family home since April. We get along great with our landlord. Before we moved in, we talked about many things...noise, pets, etc.. One of the things she asked us was if it would be possible for us to share our cable (just basic) with the apartment downstairs. We decided we really didn't want to. Two months ago she got the apartment finished for someone to move in and asked again. We asked about the tenant(s) she would get and promised us that she would make sure to only rent to quiet, working people. We agreed that we would allow them to wire the apartment downstairs for basic only (no cable receivers, modems, etc....) The people that moved in downstairs have been horrors as far as noise. We have complained on numerous occasions. To my landlord's credit, she has talked to them and we even had a "house meeting" last night around 6. I felt the meeting went great on our end. They didn't deny the things they were doing that we had complaints about, and even acknowledged them. They apologized and I felt okay. About 8 last night, the noise kicks in again and of course I am furious. This isn't normal, everyday noise, and it goes on until midnight or later. My landlord has them on a month-to-month and made them fully aware they are on their last legs....but at the same time I wonder if she would ever evict them, or just keep giving warnings. Okay, sorry to go of course....at this point I do not want to give them access to my cable that I pay for. I hate them and feel no reason that I should do it. So, my question is. how should I explain this to my landlord? Would she obligated to do it, or since I already consented am I stuck? (more...)

Voting Question: In an abusive relationship with no where to turn. No money, no family, no friends and living in in laws house.?
I have 2 girls ages 13 and 11. We moved here 8 years ago my husbands father bought a 6 over 6 for us to live in. So stupidly I gave up my rent controlled apt. where we lived on mutual ground. Now that the marriage has gone bad I went to a dv shelter in March 2008, while there I allowed my father-in-law to have me legally evicted with all my marital stuff at my home residence and personal property, but the dv shelter said you dont want to fight the eviction anyway, cause your not safe in that house. I couldnt take it anymore being in the shelter and my husband and I agreed not to get divorced, yet he told me to stay at the shelter with the kids till I got section 8 and found an apt. Well that didn't happen, we couldn't take no more the kids had to be with me even if I had to throw out garbage, if one was in bed sick, I had to wake her up just to get the chores done, cause they inspect the apt. and if you have 3 violations your discharged to a homeless shelter. So I practically begged my father-in-law to take me back, he said the kids will never be on the street hell take them but I couldnt have my apt back. I would not give up my kids, finally on June 14 he took us back, but I had to sign something giving up all my legal rights. Like drop all charges against my husband, against him, against his grandaughter and her friend, not call hpd, not call the police and out of desperation I signed it. Now were back but I'm not comfortable so much has happened, I was arrested after being beaten up by his family, cause his father said no she hit my grandaughter and the friend. Meanwhile his father held me while they all hit me when I called for an ambulance he had already called the police, they call the police and put marks on themselves and say I did it. Went downstairs in my pajamas to wait for the ambulance, I was full of blood, the police waved away the ambulance and arrested me along with my husbands 17 year old neice and her friend. However my father-in-law did alot of physical damage to me they didnt give me a chance to tell them anything. While in the holding cell, when it was time to go to courd I had a seizure and woke up hancuffed to a bed. The court officer that took me, about my age and blonde like me said something wasnt right cause she saw me filing for a top against my husband on 1/20/08 and I was fine, she said she was there filing against her ex-husband and that the very next day they brought me in under arrest all beat up and full of blood. Anyway its an extremely long story, and I've read alot of these posts and the advice and answers people are giving. However I have none of that. I have no family that is willing to help me, not even temporarily, they are not even willing to give me moral support or take some important documents for me in the event I need them, so they are not here. Plus I have no job, no money I'm on ssi for an anxiety disorder I developed 6 years after moving here, all I get is as of Jan. 1 $800 monthly for my self and the kids and I get public assistance, that just pays rent, $575 monthly to his father, it goes directly to his father every month, plus medical benefits and $190 a month in food stamps. How do I get out of a situation like this without losing my life or losing my kids, his family has a whole lot of power over me, and they take advantage knowing I have no family willing to help me, that without them I would be homeless. Resolved Question: Can I refuse to pay my rent to a negligent landlord?
My landlord had my wife and I sign a 5 year lease on our house back in May of 2008. Since then we've had a ceiling cave in which completely destroyed the BRAND NEW carpet. We're talking soot from an old wood or coal burning fire place all over the family room floor and into the dining room. Then we got a letter from the city on property maintenance and general problems for exposed wiring that hangs between the garage and the house (doesn't work). And most recently our landlord had to have our downspouts put under ground because they were exposed from the side of the house, all the way down the driveway, to the street drain. That went well, except he was SUPPOSED to have new gravel put in our driveway soon after. Well, it's now been three months since the pipes were buried and now we have a huge mud slide from our yard into the driveway and off of the end of the sidewalk. My son has sprained his ankle on the step into the driveway and the rest of it is a HUGE MUD PIT. Do I have the right to refuse to pay my rent until the driveway has gravel in it again? There was gravel in the drive when we signed the lease and now there is MUD. What are my legal rights here. I want to file a personal complaint against this guy, but then I don't want to have him retaliate by evicting us. We are a family of four and are struggling just to make bills every month. Please let me know if there's anything I can do to make my landlord take care of the slip/trip hazzard that is now our driveway and to make him put up a retaining wall so that the yard doesn't keep eroding into the driveway every time it rains or the snow melts!! Resolved Question: what rights do i have??? ?
I moved into his brother's apartment on sept. 7th 2008. No lease contract was signed agreeing to the any terms.just the amount of $400.00 to be paid to my brother on each of my monthly pay dates! This was a verbally agreed upon transaction between my brother and I. He is payed when i recieve my monthly salary. both myself and brother are paid firefighters. New year's day is an holiday so i didn't get to give him the rent money. He lives only 1000 ft from me! every payday i go and LOOK for him and ensure he gets his rent money. At work today he asked me for the rent money in a pissed off attitude and demanded that i have his rent money by this evening. An argument occurred between us, now he's telling me that he will be kicking me and my family out of the house. consider this!!?? Q1.- what are my rights Q2.-don't i have a grace period to pay the rent Q3.- how long can i remain there if he wants to evict me Q4.-I have the rent money,but i told him that i would pay him on the 7th of january. Am i in the right? by the way, i'm just about to close on my house mortgage loan that he doesn't know about!. should i stick him!! (more...)
