Voting Question: Bought a home 2 years ago damage to the home was not disclosed?
A family member purchased a home 2 yrs ago. On Christmas Eve 2008, their home flooded it now has over 11,000.00 of damage. As they were talking to a neighbor the neighbor disclosed that the same thing had happen to the previous owners which lived there for 6 years. When the insurance came out they told them it was a grading problem caused by the builder and this would continue to happen. My questions is, isn't it against the law not to disclose when selling your home that there has been damage to it? If so, what do you recommend they do? Who do they pursue the bank, realtor or the previous owners? What can they do about it?

Voting Question: First time home buyer?
We have a contract with a builder. We are approved for an FHA loan. We knew that in order to only have to put down 3 percent, we had to get a case number before the end of the year because in 2009 it would change to a 3 and half percent down requirement. We did everything we were supposed to do and everything was great, we had a case number and everything.Then, our Realtor call us and informs us that she has the wrong address on the contract. So, we initialed the address change on our contract on the 31st after asking her if this would cause us to have to pay more. She said no. Today, our lender calls and tells me that she had to submit a whole new loan application because the of the incorrect address and that because it is now 2009, we will have to pay the additional 1/2 percent. This is very frustrating. What are our options? It just doesn't seem right that we have to pay for someone else's (the listing agent) mistake. In fact, I don't see how I am going to be able to come up with the extra money. I have asked our realtor to set up a time for us to sit down with the builder and the listing agent to discuss this. Any advise before that happens would be nice. Are we just up a creek without a paddle or is there a way to get a paddle? :)
Also, the builder has agreed to pay 5k in closing costs. Our closing costs will be only around 4k, actually 3,605 because we already had to pay 395 dollars of the closing costs in an application fee. Is there a way to get him to pay the 5 k before we close, so that we can keep the extra money and put it towards paying the extra half percent?

Resolved Question: Buying a home! Need help ?
We are interested in these 3 homes,
The builder had started building on the neighborhood but they got foreclose on. There are 10 houses that are built in the neighborhood and most aren't even no where finish. Before they got foreclose on these homes were price over a half million dollars.
All of these home are foreclose on and the banks owned them. It's probably been like that for a year now. No one stay's in the neighborhood.
The homes now are from 370's to low 300's
One home we are interest in is price at 373,000
there are no floors, toilets, counter tops, they have cabinets, no lights or electricity and it looks like it have water damage. If the house is finish it probably be apriase over 400 to 500 thousand or even more.
how much should we asked for the house?
The second home is for 309 but has the same condition as the first, how much would you asked off the price?
These are really big nice homes and in our price range , we just want to get a deal because works needs to be done on it. at least 30 to 40 thousands dollars work on the house.
The Realtor said the homes are sold as is and all the homes are over 4,000 sq ft. We really won't foreclosed homes that we can fix up and that will sell for the high when the market goes up.

Resolved Question: Builder, Realtor Relations -What if the buyers Realtor does not have a signed representation agreement?
I am a small custom builder. Our company works with Realtors on many projects. The greatest point of conflict occurs when a Realtor does not register their client with our office, does not attend any meetings but calls weeks later and wants to be involved (receive a commission) on the sale.
In one case the Realtor was a friend, did not have a signed client representation agreement, had not shown any of our homes but wanted a commission. The answer was no, but the Realtor's broker called and gave me (the low down dirty dog I am) the third degree.
The Question --does a Realtor have to have a signed client representation agreement?

Resolved Question: Our realtor wants us to sign a Exclusive Buyer Broker Agreement ! Pro & Contra?
However she is not very assertive-so far shes been showing us House far from what we've asked for- too small, one bath only- to old, too much upkeep or work to be done.
Perosnally to me it seems now, that she is representing more the Sellers Interests or other Realtors relationships with her than our Interest and favors.
I am not happy with her at all, she is a nice Lady- but a terrible Reep and Sales Person!
I have found two Objects on my own, we really like- she is however dead against them, because they are being sold by a another Realtor (which whom she claims to have a good Relationship with?!?) and she thinks, the Contratcor and Builder are trying to lock out anyone else and just want to deal with us alone- not the Case, the Builder just wants to show us the Properties and Lots he owns, so we have an advantage and a better Picture.
Now this Exclusive Buyer Broker Agreement is laying here on the table , not signed yet , but I have a rather uncofortable Feeling signing it, so does my Husband.
What if could go wrong if we cannot buy or have to step back buying?
Under "Fees to Broker" she is asking 3 % of Purchase Price, the Contract would be for 4 months and another 30 afterwards...again I am having big Trouble doing this with her- I really want a more assertive agent!
Also, we where suppose to meet the Builder today, she is not available- but dead against it! It will only be a Meeting, we are not naive or stupid..! What advice can anyone give me.
Again so far we haven't signed anything with her- but my husband feels guilty towards her, because she showed us a few houses..I don't feel any guilt, I have done most of her leg work anyway!

Resolved Question: Do I have a lawsuit? ?
I'm currently trying to sell my house in VA. My wife and I have left the house and relocated to NY. We recently found out that the builder of our home has been using it as a model. He calls a realtor who lets him in, the realtor then leaves, and the builder makes his sale pitch. Do I have a case against the realtor/builder? Is this a pretty strong case? Is this something where a lawyer will work on a contingent basis? Thanks for your help.

Resolved Question: Market Bottom? How can Analysts say that? bad advice maybe? Closer to their own Bottom more like.?
Some Market experts on TV are clearly expecting a market bottom any day now, clearly some of the have called THE BOTTOM several times already this year LOL. HEY, Even a broken clock is right twice per day, yes? they will be right too one day, or soonish. LOL
Here is my point, most experts agree that a market bottom in the past is always ahead of the economy by several months.
So if projections by the International Monetary fund (IMF) are looking at a 2 year downturn and housing Builders, Realtors are looking at 2 years before the market ceases going down and Ben Bernanke and Paulson are talking in years of recession, one of the worst recessions we will have known, Buffet and Soros are talking years of recession etc.
WHAT justification do the market experts have in even thinking that a bottom is imminently close and in so doing misleading investors into buying.
Clearly there is surely ONE Full Year of the market going down till January 2010 before we can start to re evaluate the market as possibly bottoming out.
I cannot see this Market bottoming until House prices have stabilized and Houses start selling again.

Agreed that Obama should have been on the list. And of course, ACORN.
And after this happened can ya believe that the Dems tried to give 20% of 700 billion to ACORN? Amazing.
"Homebuilders and realtors have been hit the hardest by this economy."
Of course now they crying foul, but they made plenty of money when they drove the market up. Knowing full well that the prices could not be held that high. But they didn't care then, it was all about easy money.
