Open Question: My rental condo is in FORECLOSURE... the bank offers me cash!??!?
hey everyone... Just got home from a 2 week vacation... I have been renting a 3 bedroom 3 bath condo in Orange County California for about 2 years now. Yesterday morning someone brought over a paper informing me that the condo went under foreclosure and I have 60 days to move... This is the first I have heard of this... you can not see the door numbers clearly on the door so maybe they have posted some papers on someone else's door and it never found the correct location, or maybe the wind, who knows.... in any case here is what happened... after finding out our home will soon be taken out from under us and checking the mailbox after our 2 week vacation and finding more info about the foreclosure im pretty sure its solid. I tried to contact the land lord MANY TIMES with no results... I have paid my $2,300 rent at the 1st of this month and the check was cashed on the 2nd... im pretty much thinking that im 100% screwed... the letters say that the condo was purchased by another Bank and not a private party or individual... this morning I get a call from the guy in charge of the newly acquired real estate who is in direct contact with the bank... He tells me that the bank is willing to offer me a set amount of cash to help me move.... i tell the guy that i am just a renter and i dont own the property and he tells me that, "If you were the owner the bank would not offer you this, they would just kick you out"... so he asked me if i was interested in the offer and I told him that ,"I already paid rent, why not?!" so he told me that he would talk with the bank and get back to me soon.... not long after that they guy calls me back and tells me that the bank is willing to offer me $3,000 to move out within 30 days... I told him that $3,000 will barely cover moving expenses and not even cover security deposit on a new place and first and lasts months... I countered for $4,000 if they really wanted to help... my paper says i have 60 days.... bank is offering me cash for keys within 30 days... i think they are willing to pay the $3,000 to get me out sooner so i dont destroy the property... is this common for the bank to offer money? if so, dont mean to sound greedy but how much might i be able to ask for... this whole move is going to cost more then i can imagine... plus giving into account that I have been renting a 3 bedroom 3 bath condo in Orange County California for about 2 years now. I was doing Home Loans before the market went under and now I own a semi successful web design company. I pretty much only make enough for rent between my girl friend and I and since the market crash I now have bad credit from my previous High Cost of living expenses and my GF's credit isn't too hot as well. I have ALWAYS paid my rent in time but getting in contact with the "land lord" has been impossible... they are my only hope for a positive review on my excellent rental history for when I move into a new place. Now with having BAD CRDT and NO RENTAL HISTORY and also to make things worse... NO SECURITY DEPOSIT.... i dont really know what I am to do... thanks in advance for the advice. (more...)

Open Question: Both my cars were involved in a hit and run. I have full coverage, will my insurance pay?
On the day after Thanksgiving 08 both of my cars were parked in the street next to each other and someone hit my small car into my new car and totaled the rear car and the car in the front was damaged. The front car was fixed ( I paid $500 for my deductible ) and now the rear car my insurance is telling me they won't pay if they do not know who the driver is. I have full coverage, if full coverage does not cover this type of accident then what insurance does? My response from my claims adjuster was (We don't know who to bill so we can't pay you). They already towed my car away and now I don't have my car, I don't have payment for my car. and I have a 250 dollar rental car bill. Are they lying to me? Someone please help. p.s. Open Question: Landlords ONLY Please: What State has the strongest Landlord Rights?
I have been a landlord in Los Angeles for many years and I am sick to death of the loser tenants and the states willingness to allow them to hold property hostage when they don't comply with their contractual agreements. The latest is this jerk who moved in on a month to month rental of a room in a large home (10 bed, 4bath) at 800/mo plus a share of the utilities. His utilities were 63.00 for himself and 63.00 for his girlfriend and he owed 400.00 on an 800.00 deposit which he agreed to pay on the 1st of this month. He failed to pay the remaining deposit and is now failing to pay his utilities. I am sick of the California BS. It costs approximately 1500.00 and takes up to 12 weeks to actually evict this ah-ole. Where can I invest (what state) that actually protects a property owner? Does one exist? I really want to hear from other landlords, please. Thanks for reading. (more...)

Open Question: Equity Loan or Conventional? What type of loan should I get?
I have about 20K in I-Bonds (face value). I am going to purchase a 2nd home as a rental property; same town. The rental is $62K. The house I live in is worth about $160K and I owe about $63K on it. I have been qualified under both equity and conventional and on the 5-1 arm as well. I have excellent credit 750's but due to the property I want to purchase being a rental, the interest rates I am getting are very high. 8.93 on the equity with nothing down and 5.1 with 20%down on the conventional. The 5/1 Arm gives me hives so I am kinda staying away from that one. What do you all recommend. I really did not want to part with the I-Bonds. They have not yet matured and I kinda wanted to use them for my kids first year of college in 5 years but the 2nd house is to help me pay for their college as well. I will be done with my 1st house in 4 1/2 years. What do you suggest. (more...)

Open Question: I am so excited. Moving!?
I hate moving. I grew up with my family moving about every 2 years or more. 2 1/2 years ago, I moved to a town where I was offered my dream job. Luckily, I had family there because I had to take the job with no notice. After a 2 week trial, I landed the job and had to move on the fly as it were. I ran across a small house for rent close to my aunt's home. I didn't like the house but it was within my budget and the landlord let me keep my pets. My furniture didn't fit, the carpet was at least 20 years old, the kitchen so small you have to do a dance to open the refrigerator door. The walls were the old, cheap dark wood paneling .He promised to change the windows out as they were rotten. Of course it didn't get done. The washer and dryer hookups are in the dining room, displacing where you would put the table. Try watching tv with the washer in spin cycle on an uneven floor. You can't even hear someone yelling at you. Every month, I took the rent downtown to the historic district (where the landlord lived). I would park in front of the antebellum home with the white columns with top and bottom porch and dream of living in it. I knew he had converted it into apartments but they were full. Sadly my landlord died last summer. His young daughter took over the management of the rentals. Time and money problems has kept her from doing any maintenance to my house. During Christmas week, I called her and reported a break-in at my house. I cleaned up the mess the thieves left and went to stay with relatives here in town. Again on New Years weekend, my house was broken into. With the windows rotting, there is just no way to keep them out. Yesterday, I met with my landlord at the "big house". Someone had moved out and I got to see the interior for the first time. This apartment is created from the former dining room (now a dining/living room). Fireplace with pink marble, butler's pantry for storage. Large enough for all my furniture even my dining room table. The side porch was enclosed to create the kitchen, small but functional. The hallway leads to the bath (clawfoot tub, pedestal sink, recently remodeled) and the bedroom. Once my landlord can clean out what was the front parlor (her father used it for storage), I will have a second bedroom with yet another fireplace. This place is has all the original molding and the brass chandeliers. There are even the huge fancy mirrors over the fireplaces. 12 foot ceilings and hardwood floors are a passion of mine. You can imagine my family listening to me bursting out all night long with "I'm moving to my dream apartment." This was the place I had been looking for when I moved here and could not find. So I start tomorrow to pack and move anything I can carry, then family will help me move the big stuff. Room by room, box by box. This time with a grin on my face. (more...)

Open Question: Can I take a real estate agent(s) to court?
Husband and I was trying to purchase a home. We contacted an agent. We (not the agent) began house hunting. We contacted the seller's agent and then contacted our agent to begin the contract. The agent decided what offer we should make. At the time, we thought it was in our best interest since he was our agent, exclusively. We waited a few weeks for the contract to be approved. By this time, the agents (buyer/seller) weren't communicating and my agent was lacking communication, so I decided to call the seller's agent to check the status. The seller's agent was confident that we would close by a specified day. I asked the agent if I should put in my 30-day notice. He told me yes. He didn't advise me that I should ask my agent nor did he say that I shouldn't be asking him. I saw no harm in asking. Well, I packed up and moved out within 30 days. We didn't close. Now my family and I are homeless because of this. We have been since the 3rd week of October 2008. We had taken money out of our 401k for a downpayment on a house that we are living off of (which was only $7000) which is now exhausted. Our agent didn't seem to help the situation, although he was upset that the other agent did that but the other agent is acting like nothing has happened. I feel like they owe us something. We have spent this money for hotel/motel expenses, food, and other related things. We have children that are affected by this. We aren't able to get the house due to errors on our agent's part. I wanted to know if I can make a lawsuit for this somehow to be reimbursed and/or for pain and suffering/punitive damages. We are in this situation because we trusted an agent. That money we used from the 401k would have still been there if we didn't need to use it and we would still have a roof over our heads if the agent hadn't told us it was okay to put in a 30 day notice. I don't know think an attorney is necessary for small claims court and I'm sure they wouldn't touch it because it's not a substantial amount of money that they can benefit from. It's harder for us to find a rental with no money. Wow I'm glad to see that everyone says all this is my fault! I took responsibility for my action. How do I check to make sure they're legitimate? The rate seems low considering it is described as a "luxury" rental home, offered by an individual owner in England. How do I know if the owner is the actual owner, and it is not a home in foreclosure, or if it even exists? Open Question: Question about notice to move out of a rental?
Ok long story short. We rent from my husbands boss and rent comes directly out of the paycheck every 2 weeks. So we actually pay rent bi-weekly instead of monthly. The landlord aka boss is being a real jerk and refusing to fix things and we can't afford to make waves and cost (illegally) my husband his job during this economic crisis. So we are moving, but we are moving 45 minutes away in snother state. We are in California and we did have a lease agreement signed 14 months ago for no set amount of time, month-tomonth basically and they are not holding up their end of it to fix things that are not reasonable for us to fix (broken oven, broken fridge, fallen fence, barely working and dangerous furnace etc.) So we want our move and my husband quitting to be as much of a surprise as possible because we fear if we give 30 days notice he will terminate my husband thus forcing us into paying double rent because our contract does state that if my husband is no longer employed by him we have to pay the full amount of the mortage as rent if we want to stay. So my question is since we pay rent bi-weekly does that also mean we can give a 2 week notice to move rather than 30 day? That way we can give notice on the house and job the same day and the last rent payment will have been taken from that check and we won't owe him any more and he won't be able to take advantage of us anymore. Oh and yes we know what he is doing is illegal and as soon as we have a stable job set up and a new rental home we plan to have a code enforcer come in and report the boss/landlord for what he has been doing, but until we are set to go we have to keep quiet. Well we cannot afford a lawyer, no way no how. I do not have a copy of my lease, my mother managed to lose it for me when we were moving into this place but I plan to tear apart the garage and find it. But either way are ARE moving, not only because of the situtaion with him, but because we live in a very expensive place and we will never get ahead here. So we are moving for more oppurtunity and a better cost of living. Oh the house is in BETTER condition (should have mentioned that.) This house was a forclosure in need of repair when the boss bought it. The lease agreement stated we were responsible for all 'reasonable" repairs and we have made a good 2k in repairs to this house, money we DO NOT have to spare. All the problems were preexisting. The only difference is we will be taking our fridge when we move because he refused to replace the one that broke 2 weeks after we moved in so we replaced it with one we bought from a friend. We did not break the fridge either, it had its compresser replaced twice before and it was done, no fixing it. We have never left a house in disrepair done by our hand. We always pay or rent on time every time before it was direct withdraw, don't leave houses trashed etc. We are good renters, always get our deposit back. Last detail. The rent comes out of the pacheck for the NEXT 2 weeks. So when I pay rent this week it will pay for 2 weeks after that, not the other way around so we won't owe him anything even with a 2 week notice on job and house. My hubby's position will for sure be filled. I can't explain, but its already taken care of. The entire staff plans to leave, not just my hubby, they are all sick of it all over there. He won't be able to take further money from hubby's last check either because hubby will withdraw the authorization to have money deducted from his pay. My husband has a very good eomployment record and we have an excellent rental record, so we aren't worried there. We do realize that if wecomplain and he fires/evicts us we have a lawsuit, but that still leaves us jobless and homeless and in a colitile situation because this is a very small town. Thats why we just want to get out quietly with out minimum legal notice and move on and reserve our hand until we NEED to play it. The law says we can give 2 weeks notice here (just found out) Unless out lease states otherwise, so we need to get a copy of that and find out. should have read "with out legal min notice" not "with out" With OUR leagl min notice, holy moly I need to learn to type! Open Question: Abnormally high KWH usage= High electricity bill?
OK... I'm going to try to sum it up for you but give you as much detail as I can.... I moved in to a rental home May 08. Simple 1500 sqft 4bd 1.25 ba, a living room, kitchen and a laundry room. During the summer months (end of June through end of August) I have my 3 young (9, 7 and 5) kids every other week. During the school year I have them full time minus 2 weekends a month. For May my average KWH usage was 18 a day. For June, July and August my average daily KWH usage was 17. September it jumped to 21 but school had started and we were home more. Then October it went to 34 and November to 40 and December was 40 also. So here's my concern: The only change is that we have been using the 2 wall furnaces to warm the house. The thermostats are set to 65 during the day and 60 at night. I live in the Southern California mountains so I don't need or have an air conditioner in the warmer months. That helps with keeping the KWH low. My water heater, oven/stove, clothes dryer and wall furnaces are all GAS! So why the outrageous spike in usage? I called SCE and they asked if I was heating a pool or hot tub or if I had been running an air conditioner or if I had an unusual amount of Christmas lights up. I explained to them that I did not have a spa or a pool, or even an air conditioning unit and that the only Xmas lights I had up were the 7 strands I had on the tree. They seemed baffled too and sent someone out to reread the meter. Of course- the reading was correct and apparently I used 1225 KWH last month. How? I have no idea. I do not use any space heaters, all the appliances (stove, dishwasher, refrigerator, washer and dryer) are 2005 or newer. The upstairs to the home is the kids area. 3 small bedrooms, and a bathroom with a sink and toilet only. The kids rarely go upstairs. They like to sleep in my room and we all basically spend 90% of our time home on the main level (my room, main bath, and the combo living/dining/kitchen area room). I go upstairs 3 or so times a day to make sure the lights are out, which they always are. So I just don't understand why the increase. Any ideas?? (more...)

Open Question: What are the pro's and cons of renting a house with option to buy?
I am seeing this new trend of renting a home with the option to buy. I read some info on this type of rental option and it explained that you sign a contract of an agreeable amount for the sale after a certain amounts of months. It almost sounds too good to be true. We have been working to clean up our credit to purchase a home of our own, but I know that it takes time for the paid items to reflect your credit score. We also will only be using my partner's income because I am finishing up school in May and will be able to work full time after that. I am just wondering if that would be a good option for us to look into rather then using only her credit and income since I have no recent employment history. A broker told me that he would not feel comfortable even including me in the process until I was employed full-time for a minimum of 6 months and all my items on the credit report were in satisfactory standings (referring to a good payment history on my student loans....which are not due until I am completed with my education).
